ഫെഡറൽ നിയമങ്ങളെ ലംഘിച്ചുകൊണ്ട്, അമേരിക്കൻ പൗരന്മാരേക്കാൾ മുൻഗണന അനധികൃത കുടിയേറ്റക്കാർക്ക് നൽകുന്നുവെന്നും നികുതിദായകരുടെ പണം ഇതിനായി ഉപയോഗിക്കുന്നുവെന്നും ജസ്റ്റീസ് ഡിപ്പാർട്ട്മെന്റ് വാദിച്ചു. കോടതി ഈ വാദം അംഗീകരിക്കുകയായിരുന്നു.
